<br /> <br />-37- <br />XXI. Miscellaneous Compliance <br />Signs and Markers are in Compliance. <br />All other issues within this section have been resolved during the course of <br />the review. The operation is found to be in compliance with the requirements <br />of this section. <br />XXII. Operations on Lands Subject to Limitations or Prohibitions - <br />In accordance with Rule 2.07.6(2)(d)(iii), the Division finds that the <br />proposed permit area is not within areas subject to limitations or <br />prohibitions except for the following two situations: <br />1. Fremont County Roads 72,92, and 115 pass through the proposed permit <br />area. Permission and public notice were given by the Fremont County <br />Board of Commissioners. Documentation of the authorization and public <br />comments provisions are given in Section 2.05.3(3)(c) of the Second <br />Adequacy Response. <br />2. The Dorchester No. 1 permit area is within 300 feet measured <br />horizontally of an occupied dwelling. The Thompson ranch house is <br />within the permit area. A valid waiver existed as of August 3, 1977. <br />Documentation of that waiver was supplied in Appendix C to Attachment E <br />of the Second Adequacy Response. <br />XXIII. Demonstration that Surface Coal Mini <br />A review of the operations, hydrology, topsoil and vegetation sections of the <br />application shows the operation to be in compliance. The Division therefore <br />finds that reclamation operations can be feasibly accomplished. <br />XXIV. Compatibility with Anticipated Adjacent Operations...... <br />The assessment of the cumulative hydrologic impacts of mining has found that <br />the Dorchester operation and adjacent operations will not materially damage <br />the hydrologic balance outside the permit boundary. <br />The subsidence section of the application indicated that the Dorchester <br />underground workings are compatible with the adjacent GEC mine where the <br />Dorchester and GEC permit boundaries intersect. <br />Finally, the Magpie Creek diversion relocation and reconstruction plan has <br />been designed to be compatible with adjacent operations. <br />The Division therefore finds the operation to be in compliance with the <br />requirements of this section. <br />
