-34- <br />The applicant proposes to continue the construction of a waste pile initiated <br />under the interim program permit for the Dorchester No. 1 Mine. This pile <br />contains both underground development waste and coal processing waste from the <br />mine's processing plant and belt press. The reader is referred to Section <br />XVIII, "Coal Processing Waste and Non-Coal Processing Waste" of this Findings <br />Document for a specific discussion of the waste pile. <br />The operation is found to be in compliance with the requirements of this <br />section. <br />XVIII. Bonding -Rule 3 <br />The Division has reviewed the reclamation plan and cost estimates provided by <br />the applicant. The Division is increasing the bond in excess of Dorchester's <br />calculations to include the cost of reclaiming Pond #5, designing and <br />reclaiming the Magpie Creek Diversion, and conducting a stability analysis of <br />the access road to the refuse site. The Division has not required bond to <br />cover potential damages to the Florence city waterline at this time (see <br />Sections VI and XXIII). However, if future subsidence data indicates that <br />damage is likely to occur, the Division may require an increase in bond to <br />cover repairs. The Division is setting the bond required for this permit term <br />at $1,100,000. This bond will need to be submitted and approved prior to the <br />issuance of this permit. <br />XIX. <br />All drill holes will be sealed in accordance with Rule 4.07 with a <br />quick-setting drilling mud, as was approved on November 9, 1982 in the <br />Developmental Drilling revision. <br />The portal sealing plan as previously mentioned satisfies the Permanent <br />Program Regulations. <br />XX. Subsidence - Rules 2.05.6(6) and 4.20 <br />The applicant has completed an inventory of structures and renewable resource <br />lands within and adjacent to the permit area. The applicant has completed a <br />subsidence survey, containing predictions of anticipated subsidence effects. <br />The amended application document also contains various proposed subsidence <br />control plans and subsidence monitoring programs for each of the affected <br />structures. Attachment E of the permit application contains the majority of <br />this information. <br />Dorchester Coal Company's subsidence inventory delineated the following <br />potentially affected structures within the affected area; <br />
