Box 426 <br />Norwood, Colorado 81423 <br />RE: 14 San Miguel County Pits <br />Our file Nos. 81-154, 81-214 through 81-226 <br />Dear Mr. Sale: <br /> <br />Enclosed please find a copy of a letter from Mr. Jeff Walter, a land- <br />owner evidently adjacent to the Norwood Pit, file ~p81-154. Please <br />clarify the situation as regards possible gravel removal by San Miguel <br />County from his land. If the operation extends onto his land, the <br />acreage disturbed on his land should be part of the permit area, or a <br />separate application may be submitted if the two areas are not contiguous. <br />Since this pit area is already to be 9.5 acres, any addition over about <br />0.49 acres would make this a 112 permit application, requiring a separate <br />permit application. I suggest you contact Mr. Walter at your earliest <br />convenience. <br />You may notice that new file numbers have been assigned to Pits 2 through <br />14. The new file numbers (in increasing numerical order) correspond to <br />the individual pits in the same sequence as given in your submissions for <br />Pits 2 through 14. <br />Mr. Walter included a copy of your publication in his letter to me. I <br />noticed that the legal descriptions of each of the 14 pits had not been <br />given. Rule 3.22(2)(b). requires that each proposed operation be iden- <br />tified to ..section, township and range and street address, where ap- <br />plicable." This will necessitate re-publication for two consecutive <br />weeks, as well as the re-notification of all landowners and adjacent <br />landowners (as per Rule 3.22(3)). I am sorry about this misunderstanding, <br />but the Rules and Regulations are unequivocal in this matter. This will <br />most probably also necessitate vour requesting a further continuance <br />until the November 18-19, 1981 Board meeting. <br />I am also awaiting your reply <br />If there are any problems with <br />please call me. <br />Sincerely, <br />Mark S.
