her way to work, and had driven by the location of the rockfall. Ms. Torres stated that the rock had <br />not fallen onto SH12 at that time. Ms. Torres stated that she arrived at LCC's office at <br />approximately 8:25 am on 5/23/02. <br />Ms. Tones stated that at approximately 9:00 am on 5/23/02, she left LCC's office to visit the school <br />in Primero where her children attend, as it was the last day of school, and she had volunteered to <br />help. The Primero school is situated north of the Lorencito Canyon mine, on the south side of <br />SH 12, west of the two entrances to the mine from SH 12, and west of the location of the point on <br />SH 12 where the rockfall eventually occurred. <br />Ms. Torres stated that while traveling westbound on SH 12, she came upon the rock at <br />approximately 9:00 am. Ms. Tones stated that she continued on to the Primero school, and asked <br />the school secretary to contact the State Patrol and inform them of the rockfall. As mentioned <br />previously, a copy of a 5/23/02 Colorado State Patrol phone log indicates that a call was placed to <br />the State Patrol at 9:07 am on 5/23/02, and that a State Trooper arrived at the site at 9:32 am. <br />Ms. Torres stated that while at the school, she could observe highway traffic stopping at the <br />rockfall. She stated that she left the Primero school at approximately 9:45 am to return to LCC's <br />office, traveling eastbound on SH12. Ms. Tones stated that she stopped at the rockfall to speak to a <br />Mr. Ryan Chavez, who had stopped to help direct traffic with the State Trooper that had arrived on <br />the scene. Ms. Torres stated that she offered the mine's assistance in moving the rock with afront- <br />end loader, if the State Patrol wanted the help. I asked Ms. Torres if anyone from CDOT had <br />arrived at the site of the rockfall at this time. She stated that she did not believe so. <br />Ms. Torres stated that she arrived back at LCC's office at approximately 10:00 am on 5/23/02, and <br />that she immediately informed LCC Day Foreman Dan Reisner of her offer of assistance. Ms. <br />Torres stated that at approximately 10:10 am that same day, Mr. Chavez arrived at LCC's office, <br />requesting the mine's assistance. Ms. Tones stated that she immediately relayed Mr. Chavez's <br />request for assistance to Mr. Reisner. Ms. Tones stated that it was also at this time that Mr. Ron <br />Leef contacted LCC's office to inform them of the rockfall. Ms. Torres stated that she remembered <br />this clearly because she was on one phone line conversing with Mr. Reisner, and on another phone <br />line at the same time conversing with Mr. Leef. <br />Ms. Torres also informed me that the area around the mine, the school, and the rockfall had <br />received a significant amount of rainfall for two days, sometime before the rock had fallen onto the <br />highway. Ms. Tones stated that she thought the rainfall had occurred on Monday, 5/20/02, and <br />Tuesday, 5/21/02. <br />Mr. Reisner appeazed at LCC's office on Friday, 5/24/02, at this point in my inspection <br />(approximately 11:00 am). Mr. Reisner corroborated Ms. Torres' statements. Mr. Reisner stated <br />that after being notified of Mr. Chavez' request for assistance, he directed LCC employee David <br />Billiter to drive the mine's loader to the rockfall area. Mr. Reisner stated that he accompanied Mr. <br />Billiter to the rockfall. <br />
