Under this part of the Construction Materials <br />Statutes, if an operator has materials reserves on site, but uses the site less than 180 days the site can be <br />changed to intermittent status. This affords the operator latitude where economic conditions are variable <br />such as in Gunnison County. <br />A request for a Technical Revision to the existing permit to change the status from active to intermittent <br />must include the following: <br />1) A fee of 5188.00 <br />21 A description of the reason the site is being used intermittently and reasons for leaving the permit <br />open. <br />31 A plan that ensures annual maintenance of the site to control weeds and debris. <br />4) A plan to reclaim areas already mined to meet the requirements of the approved permit. <br />Staff, both in a 2000 and 2003 inspection, has brought up the issue of the status of this permit. Staff is <br />under a mandate to resolve al{ past noted issues for any permit. Please understand that it is staff's intention <br />to resolve this through co-operation and not confrontation. However, failure to respond to the Division's <br />past requests have required a sterner approach than desired. The Division had requested a response to <br />noted issues by October 15t" and November 2n0 2003.
