Species to be planted are subject to public and landowner review as well as approval <br />by the Division. A description of planting and seeding methods begins on page 2.05-53 of the <br />PAP, mulching on Z.OS-54, irrigation (none) on page 2.05-56, measures of success on page 2.05- <br />57, and soil testing on page 2.05-57. <br />Please revise the description of seedlings (page 2.05-52 of the PAP) as "--- and other <br />commercial shrub species available on the market that are approved by the Division that <br />are suitable to the conditions found at Colowyo." <br />Item 34. Rule 2.05.4(2)(f). The PAP is, by exception, in compliance with the disposal of acid- <br />forming and toxic-forming materials (there are no such materials on site, PAP page 2.05-57). No <br />coal processing waste is generated at Colowyo (PAP page 4.11-1). Non-coal wastes are <br />periodically buried in the backfill and covered to inhibit combustion (PAP page 4.1 l-1). Fire <br />extinguishers are kept on vehicles, and the water truck can be used to control most fires (PAP <br />page 2.05-58). <br />Item 35. Rule 2.05.4(2)(g). The PAP is incompliance with this rule. Sealing of exploration and <br />mine holes is addressed in the PAP beginning on page 2.05-58. <br />Item 36. Rule 2.05.5(1)(a). The PAP is in compliance with this rule. The postmining land use <br />description begins on page 2.05-60 of the PAP. The postmining land use is rangeland (also the <br />premining land use). No alternative land uses are proposed. Wildlife habitat is an incidental use <br />to the rangeland postmining land use. Sections of the PAP discuss ho~v topography, drainage, and <br />seed mixes are used to achieve the proposed land use. The postmining land use is demonstrated <br />to be consistent with surface owner plans and programs [however, see Rule 2.05.5(1)(b) <br />following]. <br />Item 37. Rule 2.05.5(1)(b). Colowyo owns all but approximately 1,109 acres of the land (surface) <br />to be disturbed. Comments of the Bureau of Land Management and the State Land Board <br />concerning the proposed use of their lands were not found during this review. <br />Please provide a reference to existing comments of the Bureau of Land Management and <br />the State Land Board concerning the proposed reclamation land use, or acquire and <br />include them in the PAP. <br />Item 38. Rule 2.05.5(1)(c). Land use is shown on Map 17 (premining and postmining identical, <br />see page 2.05-60 of the PAP). Map 17 indicates an azea as existing surface mine, but there is no <br />surface mine in that azea today (the area is part of Streeter Fill and has been reclaimed). Map 19 <br />is referenced (page 2.05-60 of the PAP) as showing (graphically) the post-mining land use. Map <br />19 depicts no information on postmining land use. <br />Please revise Map 17 to discriminate between premining and postmining uses, or use Map <br />17 to describe premining (pre-permit) land uses, and add a map for postmining land use. <br />13 <br />
