<br />~J <br />Attachment A of Federal Permit CO-0043 Termination, November 1988 <br />Conditions of Hieing Plan Approval <br />Page 1 of 3 <br />CONDITIONS <br />OF <br />MINING PLAN APPROVAL <br />This document contains the applicable conditions of approval of the King mine <br />mining plan approved on Hay 20, 1982, for Federal coal leases C-29125 and <br />P-058300. National King Coal, Inc. is hereinafter referred to as the <br />lessee/operator. <br />Condition 1. Statutes and Regulations.--The mining plan approval was made <br />pursuant to Federal coal leases C-29125 and P-058300; the <br />Mineral Leasing Act of 192D, as amended (30 U.S.C. 181 et <br />seg.); and in the case of acquired lands, the Mineral Leasing <br />Act for Acquired Lands of 1947, as amended (30 U.S.C. 351 et <br />se .). The mining plan approval is subject to all applicable <br />regulations of the Secretary of the Interior including, but <br />not limited to, 30 CFA Chapter VII and 43 CFR Group 340D, and <br />to all regulations of the Secretary of Energy, which are now <br />or hereafter in force; and all such regulations are made a <br />part hereof. The lessee/operator shall comply with the <br />provisions of the Water Pollution Control Act C33 II.S.C. 1151 <br />et s~ce .), the Clean Air Act (42 U.S.C. 7401 et s~ce .) and <br />other applicable Federal laws. <br />Condition 2. The current mining plan approved on May 20, 1982, covers all <br />or portions of Federal coal leases C-29125 and P-058300 as <br />described below: <br />T. 35 N., R. 11 W., N.M.P.M. <br />Section 31: N1/2N.1/4,SE1/4, S~1/4IT'1!4 <br />Section 32: SW1/4, SE1/4Nv71/4, W1/2N~11/4 <br />Condition 3. The lessee/operator shall conduct coal developmeat and mining <br />operations only as described in the complete nerr:it <br />application package approved by the Colorado Mined Land <br />Reclamation Division, except as otherwise directed in the <br />conditions of the mining plan approval as contained herein. <br />
