(Determined by specialist) • <br /> <br />ADhIINISTRATIVE TIME DEADLINES <br />112 Regular Permit Applications <br />GENERAL POLICY: <br />• An application for a new permit or an amendment to an eaistiog permit is not considered received until <br />the application is determined to be administratively complete by an authorized DMG representative. ( <br />See existing policies oo what constitutes administrative completeness.) <br />• Day one is always the day following the agency's decision that the application is administratively <br />complete. <br />• If a decision date falls on a holiday or weekend, the next business day is the decision date. <br />• Complex or controversial applications always require that the decision and hearing dates be verified by <br />your supervisor. If the dates cbange, they must be re-verified <br />• Every party to a hearing before the MLRB require a minimum 30 days notice, unless all parties agree in <br />writing to waive their right to the 30 day notice. This notice requirement includes parties to permit and <br />amendment application hearings. <br />CLARIFICATION OF DECISION AND HEARING DATES: <br />• Counting of the 20-day public comment period begins the day following the date of the last publication. <br />• The Division's decision can occur no sooner than the 31~ day from the end public comment period. Day one <br />is the day after the 20th day of the public comment period. If the comment period ends on a weekend or <br />holiday, the comment period must be extended to the next business day. <br />• The Division must consider the application by the 90th day following the date the application was considered <br />received. The Board must consider the application by the 120th day following the date the application was <br />considered received. The Division or Board may extend the date for consideration by sixty days from the dace <br />of the 120th day, but only if the application is complex, for unforeseen circumstances, or significant snow <br />cover that prevents a preop. inspection. <br />• If an objection to the application is submitted during the public comment period, and where the applicant has <br />submitted a change to the application that is considered 6y the Division to be a Technical Revision (TR) or <br />Amendment to the application, the Division must extend the time period at least 20 days if the change is a TR„ <br />and 45 days if the change is an amendment. In no case can the time period be extended more than 90 days <br />from the date the revision is considered received. <br />• If the Division has not received an objection to the application, and the applicant has submitted a change to t}ie <br />application that is considered by the Division to be a Technical Revision (TR) or Amendment to the <br />application, the Division may extend the time period as necessary to afford the Division the time it needs to <br />adequately review the revision.
