U
UJ~oming Fuel Com~on~ ~'~
INTEROFFICE CORRESPONDENCE
TO: Distribution I~.!-' June 10, 1988!
FROM: Geoff Weston vU"v ,
iN RE: Undermining Privately Owned Surface - Update
We have received the signed approvals from Jose Chavez and
from the bank, who owns the Picketwire Ranch.
Th e required notice has been sent to MSHA regarding
undermining the Purgatoire River and, so far, they have not
required further information.
Th erefore, I see no reason why 1st North Section cannot
r~ntinue on its present co,~rsA.
:.~:ar~in? ='rd L~01'CP. "_~= SUrIl!':e ~:•=.•ers ;::e~~,.:err.'. __ -.r•.~ ..
acre r=CEi11 Coal tract h.sve r,o'_ yct responded. Robin Forte is
pursuing this aspect. CMLRD and OSM have decided that a
Technical Revision (72 + days) of the Permit will be required to
include the Federal tract. OSM originally wanted a Permit
Revision (180 + days).
It will take some two to three weeks to assemble the
T echnical Revision data, so it should be possible to acquire the
CMLRD/OSM approval before 3rd North reaches the Federal tract, if
its present rate of advance is maintained and if the surface
owners give their consent.
Incidentally, when we were researching the Federal J.eases we
discovered the following condition:
"Section 17. EMPLOYMENT PRACTICES.
. The lessee shall restrict the workday to not more
than eight hours in any one day for undergrou;id workers,
except in cases of emergency. ."
GW/ch
Distribution:
J. R. Wilson
Charlie McGlothlin
Mike Kolin
Robin Forte
Linde Trumbly
s
