SHELTON, Director <br />April 17, 1985 <br />Mr. Phil Spano , <br />Henderson Development Co. <br />2080 West 60th Avenue <br />Denver, Colorado 80221 <br />Re: Henderson Development Pit - Permit No. 80-110 <br />Dear Mr. Spano: <br />On April 9, 1985, the Mined Land Reclamation Division inspected this site for <br />compliance with the approved permit. This inspection report was sent to you <br />previously under separate cover. <br />Based on this inspection, the Division has reason to believe a violation(s) <br />may exist at this site. The basis for this belief is as follows: <br />1. A 25-foot setback was to be left between the mining operation and the <br />permit boundary. Mining has occurred on the north side of the site <br />into and through this setback area causing the fence in places along <br />the boundary to cave into the pit. <br />2. All topsoil is to remain on site, is to be stored on the 25-foot <br />setback area and on Phase I area, and is to be respread onto reclaimed <br />areas to a depth of 6-12 inches. The only topsoil stockpile found by <br />the Division was in Phase I (measuring approximately 85'L X 11'W X <br />6'H). There were no topsoil stockpiles found along the 25-foot <br />setbacks or in any other area. <br />The Division has scheduled this matter before the Mined Land Reclamation Board <br />at their April 24-25, 1985 meeting.
