Consideration of a possible notice of violation, cease and desist order, corrective actions and civil penalties for failing to file a Notice of Intent prior to engaging in exploration activities. The Board found the operator in violation for failing to file with the Office prior to initiation of exploration activities a Notice of Intent to Conduct Exploration. The Board issued a cease and desist order from any further exploration until a Construction Material Notice of Intent to Conduce Prospecting permit has been issued by the Office. The Board ordered the operator to secure an approved Construction Material Notice of Intent to Conduct Exploration permit within 60 days of the signed Board Order and required the operator to post an interim reclamation bond in the amount of $250.00 no later than July 14, 2006. The Board assessed a civil penalty of $566.00 for staff time and $50.00 per day for 14 days for a total of $1,266.00 with all but $816.00 suspended if the corrective actions are complied with within 30 days of the signed Board Order. Consideration of a possible notice of violation, cease and desist order, corrective actions and civil penalties for failure to obtain a reclamation permit prior to engaging in a new mining operation. The Board found the operator in violation for failure to obtain a mining permit. The Board issued a cease and desist order until a permit is received. The Board ordered the operator and/or landowner to secure an approved Construction Material (1 lOc) permit by July 17, 2006.
