Ponce, Track Supervisor <br />with the Santa Fe Railroad (copy enclosed). In his letter, Mr. Ponce raises some concerns <br />with the Raton Creek Mine's Santa Fe loadouts (I believe Mr. Ponce incorrectly identifies the <br />permittee as Trinidad Basin Mining; I have attempted to call him to address this inconsistency, <br />but have been unable to reach him(. Mr. Ponce's concerns include possible impacts to the <br />railroad track and drain pipes, as well as with the roof bolts used as permit boundary markers. <br />Please contact Mr. Ponce as soon as possible to resolve his concerns with the impacts to the <br />track and drain pipes. With regard to the perimeter markers, we suggest that Energy Fuels <br />and Santa Fe Railroad discuss the possibility of using a different type of marker that would <br />remove any potential hazards to railroad workers and still comply with Rules 4.02.1, 4.02.3, <br />and 4.02.4. <br />Please call me for any assistance I can provide in helping Energy Fuels address Mr. Ponce's <br />concerns. <br />Sincerely, <br />Daniel I.
