Honorable Judith A. Boulden, United States Bankruptcy Judgre, on <br />Wednesday. September 29, 1993, at the hour of 3:00 o.m., ar as <br />soon thereafter as counsel may be heard, in Judge Boulden's <br />Courtroom located on the third floor of the Federal Courthouse <br />Building located at 350 South Main Street, Salt Lake City,, Utah. <br />The Motion requests approval of a settlement of this adversary <br />proceeding between the parties. CF&I brought this action against <br />Shieldalloy alleging that certain transfers made to it constitute <br />avoidable preferences under 11 U.S.C. § 547(b). The parties have <br />agreed to settle the matter with Shieldalloy making a payment of <br />$35,000.000 and being permitted to file an unsecured claim in the <br />same amount or an amended unsecured claim including such an <br />amount. Copies of the Motion and the related settlement <br />agreement may be obtained by request from the undersigned counsel <br />for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must lie <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Tuesday, the 7•th day of <br />September, 1993. Absent timely filing and service of objections, <br />the hearing may be stricken and the relief sought in the Motion <br />may be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sought in <br />2 <br />
