original Permit boundary. A revised map showing a "proposed boundary configuration" must <br />be provided for an area of the same acreage. <br />Resuonse: <br />The Operator was unaware that past mining-related disturbances exceeded the <br />boundary of the original Permit Affected Area shown on the 1979 map. The current Operator <br />has not expanded the disturbed area beyond the area that was disturbed by previous operators <br />under the Pennit. <br />The Operator is submitting a "Proposed Affected Area" boundary on the attached <br />map. The Proposed Affected Area is 10.0 acres. The Proposed Affected Area has been <br />configured to not only encompass disturbed areas, but also to include all areas that will be <br />included in the reclamation plan for this Permit. <br />The pre-existing exceedances of the original Permit boundary all fall within valid <br />mining claims controlled by the Operator. The Operator has the right of ingress and egress to <br />all of the area shown within and adjoining the Proposed Affected Area boundary. <br />5 <br />
