<br />has not been complied with. <br />Part 2 <br />Once bond forfeiture occurs Rockcastle and its officer, directors, agents and contractors shall <br />no longer be subject to civil or criminal penalties pursuant to 34-33-123 C.R.S. This part of <br />the agreement has not been complied with. <br />Part 3 <br />It is clear at this time that Rockcastle is interested in performing its obligations as outlined in <br />this agreement; however, some items remain unresolved at this time. Therefore, this part <br />has not been complied with. <br />Part 4 <br />This part addresses bond amounts and backfilling and grading relationships. All backfilling <br />and grading has been completed, and the currently approved bond amount is $35,000.00. <br />Therefore, this part can be considered complied with. <br />Part 5 <br />This part clearly states the Division's rights to pursue under State and Federal laws additional <br />reclamation funds in the event actual reclamation costs exceed the fmal forfeiture amount. <br />This part is not relevant to the completion of this agreement. <br />IX. -Modification of Agreement <br />The agreement was modified with regard to the lowering of the fmal forfeiture amount to <br />$25,000.00. Barring further modification, this part can be considered complied with. <br />
