Box 456 "•.~INERNLS ~ hEGLUi;v <br />Montrose, ~ 81402 <br />RE: STUCKES2 MESA DGMES`PIC WATER USERS WATER RFPLACEME2TI' PLAN <br />Dear Mr. Kepler: <br />I am enclosing a copy of a letter sul~nitted to the BIM which e•~rizes the <br />cirownstanoes surrounding Cyprus Orchattl Valley Coal Corporation's (COVCC) <br />starling with respect to obtaining approval to conduct mining operations in the <br />vicinity of a spring supplying domestic water to the Stucker Mesa Domestic Water <br />Ccx~any. Tne spring, known as the Upper Cabin Spring, is located within the West <br />Roatcap Creek drainage approximately at the intersec,-tion of Sections 9, 10, 15, <br />and 16, Township 13 South, Range 92 West. As we discussed briefly on the <br />telephone November 6, it appears as though OOVCC will be required to develop a <br />water replacement plan to protect the Stucker Mesa Domestic Water Company's <br />interest in this spring prior to being allowed to mine within the drainage <br />containing the spring <br />A replant plan has been conceptually formulated whereby replacement water <br />could be delivered to the Stucker Mesa Domestic Water Cow via the extension <br />of an existing pipeline now serving the Orchard Valley West Mine located in the <br />northwest 1/4 of Section 23, Township 13 South, Range 92 West. The water to be <br />delivered under the replacement scenario world physically be derived from the <br />Orchard Valley Well No. 3 located in the northwest 1/4 of Section 24, 4bwnship <br />13 South, Range 92 West. Water derived frc~ this well is asrPSitly auc~lented by <br />releases from the Ebst Beckwith Reservoir. 'This augmentation water is owned by <br />the Stewart Ditch and Reservoir Oomparry arl leased to COVCC through April 24, <br />2027. Zhe idea would be to continue the augmentation plan as now established but <br />to c3~vxle the point of use of the water by extending the pipeline >f required. <br />In the event replacement water continued to be required beyorri the year 2027, <br />COVCC would file an alternative augmentation plan specifying a COVCC owned water <br />riot to utilize as a replacement source of water to augment wntinued <br />withdrawals fran Orchard Valley Well No. 3. Shares owned by COVCC in the North <br />Fork Farmers Ditch could be dedicated to this purpose if required. <br />The Stucker Meta Domestic Water Co~any has requested that COVOC contact the <br />Division of Water Resasoes arc] appraise your office of our situation aryl the <br />
