<br />Dear Mr. Dudash,
<br />I have received your letter advising that the referenced
<br />matter will be taken up by the Mined Land Reclamation Board during
<br />its monthly meeting of May 25 - 26, 1994.
<br />I would request that this matter be scheduled at the beginning
<br />of the first day of the Board Meeting. As I mentioned to the Board
<br />last month, the issues involved, relating to protection of the
<br />owner of a severed surface interest overlying an operating coal
<br />mine, have never been considered by the Board previously as far as
<br />I know. These new issues should be considered by the Board while
<br />it is still relatively fresh. Please advise whether you are able
<br />to accommodate this scheduling request.
