<br />(11) All tangible paraonnl property and
<br />equipment (including manufacturer's warranties, to th• extant
<br />they exist and are transferable), equipment leases, furniture,
<br />tools, motor vehicles, inventories and expendables and other
<br />tangible peraonnl property, as deliried under applicable atata
<br />law, o! Assignor (whether owned, leased, or otherwise),
<br />including without limitation, the tangible personal property
<br />and equipment described on Schedule ZI attached hereto;
<br />(iii) Any and all other tangible personal
<br />property, improvements and fixtures~ownsd by Asai.gnor ahd
<br />located on the real property described an Schedule III
<br />attached hereto (the "Real Property');
<br />(iv) To the extent Assignor has poeaesaion
<br />thereof, all buainaaa rscorda, files, books of account, vendor
<br />lists, payroll records, correspondence relating to any
<br />governmental actions, internal and external envirotunental
<br />studies performed by or for Assignor (to the extant such
<br />documents era assignable), documents relating to any
<br />litigation to which Aeaignor is or was involved, maps, plans,
<br />logs, drawings, analyses, data, studies and other geological
<br />and engineering intonaation and other records in any way
<br />• pertaining to the two coal mines located in and under a
<br />portion o! the Real Property known as the "Munger Canyon Mine"
<br />and the "McGlone Canyon Mine" (collectively, the "Mines") or
<br />the operation thereof, including without limitation those
<br />relating to engineering, drilling, geology, mining,
<br />permitting, maintenance, inventory and supply, property,
<br />royalties, title, claims, litigation, personnel and coal sales
<br />and water availability. Assignee hereby agrees that Assignor,
<br />Mack and Loma, and their respective representatives, shall be
<br />given reasonable access to all such records and materials
<br />during normal buaineas hours for the purpose of examining or
<br />copying the same at the expense oP Assignor, Mack or Loma, as
<br />applicabler
<br />(v) All cash, bank accounts, savings
<br />accounts, certificates of deposit, repurchase agreements,
<br />other cash equivalents and short term investments, insurance
<br />claims for property damage and casualty to property and the
<br />proceeds thereof, aceounta receivable, and to the extent
<br />assignable, all patronage dividends, advance or prepaid rents
<br />and royalties, prepaid expenses and dsposita, including
<br />without limitation, the bank accounts, csrtificatea of deposit
<br />and other intangible property described on Schedule Iv
<br />attached hereto;
