4. Work closely with the Foundation to develop contracts for work to be <br />• funded with Colorado River contributed/donated funds. <br />5. Appoint a technical project officer for all contracts or projects <br />carried out or funded under this Agreement. <br />6. Appoint an individual who will represent the Service in carrying out <br />its obligations under this Agreement, including authorizing the <br />expenditure of funds by the Foundation. <br />7. In cases dealing with disbursement of funds for acquiring water <br />rights, provide the Foundation with written direction of the Service's <br />Director or his designee, and a certified resolution of the <br />Imp]ementation Committee recommending allocation of the funds. The <br />resolution will contain the following information: <br />a. The specific purpose for which the funds are being disbursed. <br />b. A detailed description of the water right to be acquired. <br />c. The owner of the water right. <br />d. The exact or maximum amount to be expended in acquiring the water <br />right. <br />8. Coordinate and report upon activities of the Foundation with and to <br />the Colorado River Implementation Committee, including providing an <br />annual accounting to the Implementation Committee for all funds <br />maintained, received, and/or expended pursuant to this Agreement. <br />• 9. Continue to maintain separate accounts for funds appropriated by <br />Congress for the acquisition of water rights, and contributed/donated <br />funds received prior to the implementation of this Agreement. Use of <br />funds in these accounts will be coordinated by the Service, on behalf <br />of the Implementation Committee, with those maintained by the <br />Foundation under this Agreement. <br />B. Foundation Obligations - The Foundation will: <br />1. Serve as the Service's designated agent for accepting and <br />administering contributed and donated funds acquired pursuant to the <br />Recovery Program, and disbursing these funds as approved by the <br />Service and the Implementation Committee. <br />2. Maintain these funds in a specific account, separate from other <br />Foundation accounts. Interest accruing to this Foundation account <br />will be used for the purpose for which the account was established. <br />3. Develop and/or issue, in coordination with the Service, contracts for <br />work to be funded with Colorado River contributed/donated funds as <br />identified in the approved Implementation Committee work plan. <br />Appoint an individual who will represent the Foundation in carrying <br />out its obligations under this Agreement. <br />• <br />
