Proposed Decision <br />Partial Bona Release Request <br />Red Canyon Mine <br />Introduction <br />This document presents the results of the Division's review of Grand Mesa Coal <br />Company's request for partial bond release for their Red Canyon Mine. Grand <br />Mesa has submitted a request for partial bond release on March 14, 1989, This <br />request for partial bond release was deemed complete July 18, 1989. This <br />request for bond release is in accordance with Rule 3.03.2. This review was <br />conducted to fulfill the requirements of Rule 3.03(2) and 3.03.2(5)(a). <br />Rule 3.03.2(2) requires the Division to conduct an inspection and evaluation <br />of the reclamation work involved after a request for bond release has been <br />received. The inspection to fulfill this requirement was conducted by the <br />Division on July 28, 1989. Surface owners within the permit boundary were <br />notified and oftered the opportunity to participate in the inspection. A <br />representative of the Office of Surface Mining, Mr. Dennis Byrnes, and a <br />company representative, Mr. James Stover, participated in the inspection. An <br />adjacent land owner, Mr. Joe Beldon, was present durino a portion of the <br />inspection. <br />Rule 3.03.2(5)(a) requires the Division to propose a decision on the bond <br />release request and to provide written notification of the decision to the <br />permittee and other interested parties within thirty days of the inspection. <br />This proposed decision is subject to scrutiny by the Dermittee, other <br />interested parties and the United States Department of the Interior, Office of <br />Surface Mining Reclamation and Enforcement. The Division's decision shall <br />become final witnin thirty nays of its issuance unless a written request for <br />an adjudicatory nearing is received. This document includes the proposed <br />decision, the evaluation, and calculations to determine bond amounts retained <br />and released. <br />
