28d. Amend Rule 4.14.2(1) as follows: <br />4.14.2 General Grading Requirements. <br />(1) The final graded slopes shall approximate pre-mining slopes, <br />or any lesser slopes approved by the Division based on consideration of soil, <br />climate, or other characteristics of the surrounding area. Post-mining final <br />graded slopes need not be uniform but shall approximate the general nature of <br />the pre-mining topography identified in 2.10.3(1)(j). The requirements of <br />4.14.2 may be modified by the Division FOR STEEP SLOPE MINING PURSUANT TO <br />4.27, FOR UNDERGROUND OPERATIONS PURSUANT TO 4.14.1(2)(e) AND (f), AND FOR <br />RE-MINING OPERATIONS PURSUANT TO 4.14.1(2)(8). where the surface coal mined <br />lands that have not been restored to the standards of these Rules and <br />sufficient spoil is not available to other;pis? comply wiCh this 4.14. The <br />person who conducts surface coal mining operations shall, at a minimum: <br />(a) Retain all overburd?n and spoil on the solid portion <br />or' existing or ne~.+ benches, and return all such material, except excess spoil, <br />to the mined out area, except as provided in Rule 4.14.1(2>(f)(h); and <br />(b) Backfill and grade to the most mcderate slope <br />possible, to eliminate the highwall which does not exceed either the angle of <br />repose or such lesser slope as is necessary to achieve a minimum static safety <br />factor of 1.3. In all cases the highwall ;Hall be eliminated., UNLESS <br />RETENTION OF A HiGHWALL REMNANT IS SPECIFICALLY APPROVED BY THE DI'7ISION <br />PURSUANT TO 4.14.1(2)(f) or (g). <br />28e.
