Mr. Tatum, the gentleman who alleges that the ventilation shaft was <br />improperly constructed, has imposed inappropriate conditions for obtaining access to the <br />ventilation shaft. A copy of his letter to William Bianco, counsel for Basin, is enclosed. <br />Basin Resources remains willing to conduct the requested investigation and to provide <br />Mr. Tatum with a copy of any data for report submitted to the State. Basin Resources' reply to <br />Mr. Tatum's letters are attached. However, Basin Resources is not willing to post an additional <br />bond for this investigation, as no such bond is required under applicable law. This site is already <br />covered by Basin Resources' existing reclamation bond. <br />If Mr. Tatum continues to refuse access to the ventilation shaft, Basin Resources will <br />consider this matter closed and requiring no further action on its part. <br />Sincerely, <br />~~w <br />Scot W.
