-23- <br />The Division specifically approves the proposed species in the seed 'mixes and <br />finds that the species meet the criteria of Rule 4.15.2. <br />The revegetation plan includes a provision for annual monitoring of the <br />vegetated areas after initial seeding. <br />On areas to be reclaimed to cropland, after topsoil replacement the areas will <br />be seeded (and mulched if appropriate to the same species as adjacent <br />undisturbed areas. Management of the reclaimed areas will be the same as <br />adjacent undisturbed areas. <br />Revegetation success for areas reclaimed to native vegetation will be judged <br />on the basis of comparisons with the approved reference area for cover, <br />production, and woody plant density. The applicant has not committed to a <br />success standard for species diversity therefore the Division stipulates the <br />following; <br />STIPULATION N0. 19 <br />SPECIES DIVERSITY ON AREAS RECLAIMED TO NATIVE VEGETATION SHALL BE DEEMED <br />SUCCESSFUL IF THE PERMITTEE ESTABLISHES AT LEAST FOUR (4) COOL SEASON <br />GRASSES AND TWO (2) FORBS WITH EACH SPECIES NOT REPRESENTED BY MORE THAN <br />THREE (3)% RELATIVE COVER OR MORE THAN 40% RELATIVE COVER. COVER T-0 BE <br />DETERMINED BY MEASUREMENTS MADE FROM VEGETATIVE COVER DATA ASSEMBLED <br />DURING SAMPLING FOR MONITORING OR REVEGETAION SUCCESS DETERMINATIONS. <br />The proposed operation is in compliance with the requirements of this section. <br />XIII. Fish and Wildlife - Rules 2.04.12. 2.06.6, and 4.25 <br />Information on fish and wildlife resources is contained in Sections 3.7 and <br />4.6.2 of the application. The permittee conducted wildlife surveys and made <br />contacts with the Colorado Division of Wildlife, the U.S. Fish and Wildlife <br />Service and the Bureau of Land Management during the period of base}ine <br />collection for the initial permit. No wildlife issues were identified in that <br />permitting action or subsequent to the permit issuance. Pursuant to Rule <br />2.01.6(2)(n) and based on available information, the Division finds that the <br />proposed operation will not affect the continued existence of threatened or <br />endangered species or result in the destruction or adverse modification of <br />their critical habitat. <br />The Division finds the proposed operation in compliance with the requirements <br />of this section. ~ ' <br />XIV. Prime Farmlands - Rules 2.04.12. 2.06.6, and 4.25 <br />Information on prime farmlands is contained in Section 3.8 of the <br />application. Based on information from the Soil Conservation Service, the <br />Division has previously made a negative determination on the presence of prime <br />farmland. This negative determination is hereby reaffirmed for this proposed <br />revision. <br />The proposed operation is in compliance with the requirements of this section <br />
