(Silt Pit), Permit No. 81-202 <br />Dear Mr. O'Brian: <br />We have reviewed your letter of March 11, 1985 as well as the approved <br />permit. Your March 11th letter was in response to our request for the <br />submission of an amendment due to the apparent change in final land use for <br />Stage L (ie.: change to floodplain). You now specify that rather than submit <br />an amendment, this area should be left as is and see what happens in the next <br />four years. <br />Our concern for this site stems from a number of areas: <br />1. June 12, 1983 letter from Environment, Inc. specifies on page 2 that "The <br />operator has an agreement with Garfield County to start reclamation in Stage L <br />by September 30, 1983. The conveyor will be removed at that time. The <br />approved seed mixtures and standards outlined in the original application will <br />be used in reclaiming the area." <br />2. June 20, 1983 meeting between the Division and Environment, Inc. it was <br />specified that this area will be reclaimed by September 30, 1983. There was a <br />4-6 year period specified but this was to allow for sufficient time to elapse <br />to allow far revegetation success prior to requesting financial warranty <br />release. <br />3. June 21, 1983 letter from Environment, inc. specifies (B.1.) "The 4-6 <br />years is the time we allow for revegetation to take. We do not expect it to <br />take that long to accomplish the reclamation work but it may take that long <br />for the vegetation cover to establish itself". <br />It is our understanding that this Stage was reclaimed by the required <br />deadline, however, the recent flooding has obliterated all reclamation work. <br />As specified above, the 4-6 year period following reclamation was to allow for <br />vegetation to express itself and allow for successful reclamation. Our recent <br />inspection of the site verifies your contention that there are areas at this <br />site with sediment deposition. However, there are a number of other areas <br />totally void of soil with only cobble material present. Therefore, your <br />belief that there is enough seed in the sediment to revegetate this area would <br />only be applicable where sediment was actually deposited and not for the <br />entire site. <br />423 Centennial Building, 13t 3 Sherman Street Denver, Colorado 80203 Tel.
