.. 1. <br />.` <br />,l <br />1993, at the hour of 10:30 a.m., or as soon thereafter as counsel <br />may be heard, in Judge Boulden's Courtroom located on the third <br />floor of the Federal Courthouse Building located at 350 South <br />Main Street, Salt Lake City, Utah. The Motion requests approval <br />of a settlement of the above-captioned adversary proceeding <br />between the parties. CF&I brought this action against Composite <br />Thread alleging that certain transfers made to it constitute <br />avoidable preferences under it U.S.C. § 547(b). The parties have <br />agreed to settle the matter with Composite Thread making a <br />payment of $12,000.00 and waiving all claims against the Debtors' <br />estates. Copies of the Motion and the related Settlement <br />Agreement may be obtained by request from the undersigned counsel <br />for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be: <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Thursday, Decemk~er 9, <br />1993. Absent timely filing and service of objections, the: <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sought in <br />z <br />
