<br />-7- <br />of the surface water and groundwater is such that all the affects <br />from the mining area will be adequately mitigated. <br />X. Rules 2.04.8, 2.05.9(2)(hJ, 2.05.6(1) and 4.17 - Climatolo ical Infor- <br />mation and Air Resources <br />Climatological information is found on pages 15-16B and in Exhibit 7 and <br />Air Resources information is found on page 9 and Exhibit 7 of the permit <br />application. These sections were reviewed by the Division for compliance <br />with the appropriate requirements. <br />The area receives approximately 15 to 20 inches of precipitation annually. <br />Precipitation usually comes in the form of snowfall. <br />The major issue concerning climatological information was whether the ap- <br />plicant needed to have an emissions permit from the Colorado Department of <br />Health given the small size and the age of this mine. <br />A letter from the Colorado Department of 1lealth stated that OC p2 is exempt- <br />ed from an emission permit under the grandfather clause of the Air Quality <br />Control Act. ' <br />Therefore, the proposed operation is in compliance with the requirements <br />of this section. <br />XI. Rules 2.09.9, 2.05.3(5), 2.05.4(2)(d) and 9.06 - Topsoil <br />Since mining at OC H2 began prior to the surface Mining Control and Recla- <br />mation Act, no topsoil was salvaged in construction of the mine benches. <br />However, 600 cubic yards of topsoil was salvaged during construction of <br />the sediment pond. This is enough topsoil to respread to a depth of almost <br />2 inches over the entire disturbed area. This generally would not be ade- <br />quate for reclamation, but the topsoil and subsoil at OC N2 are sandy loans <br />with a slightly acidic pH, low electrical conductivity, low SAR, and good <br />water holding capactiy. Thus, the mixture of topsoil and subsoil material <br />at OC k2 is of good quality as a plant growth media. <br />The topsoil may be stored for up to 95 years, but degradation of biological <br />processes should not occur since the storage pile will be undisturbed and <br />is a maximum of 4 feet thick. The topsoil stockpile has been seeded with <br />native species and stabilized. <br />The proposed operation is in compliance with the applicable topsoil require- <br />ments. <br />XII. Rules 2.04.10, 2.05.9(2)(e) and 4.15 - vegetation <br />Baseline vegetation and revegetation information is Found on pages 10-14 <br />and in Exhibit 4 of the permit application. The Division reviewed the in- <br />formation for compliance with the applicable regulations. <br />The big sagebrush community is the only vegetation type that has been dis- <br />turbed by the mining operation, however three vegetation types were sampled <br />to characterize the area. Sampling adequacy was met for herbaceous cover <br />and production and woody plant density on the sagebrush community. <br />
