-zs- <br />haul Road No. 2 is also an existing road whic7f is used for haulage and access to <br />the Pit No. 2 area. Haul road Plo. 3 is the only proposed road which will be used <br />for coal haulage and access to to the Pit No. 4 and No. 5 areas. Both Haul Road <br />tlo, 2 and No. 3 will be reclaimed at the completion of mining. A11 haul roads also <br />serve as access roads and no additional light use roads are proposed. <br />The information contained in the application verifies that the Location, design, <br />construction, drainage, surfacing, maintenance, and reclamation of the roads were <br />planned with consideration of the design and performance standards of Rule 4.03.1. <br />A11 design and performance standards contained in the Regulations were adhered to, <br />except for culvert spacing designs, as e.rplained below. <br />Rule 4.03,1(4)(e)(vi) contains specific designs for the spacing of culverts on haul <br />roads. Trinidad Basin Afining is in compliance with this spacing requirement, except <br />for three segments on Ha u1 Road No. 1, three segments on Naul Road No. 2 and two <br />segments on Xaul Road No. 3. The Division has granted a variance from the require- <br />ments of Rule 4.03.I(4)(e)(vi)(a) due to the unieue topographic features at the <br />mine, and based on a demonstration that no significant environmental or reclamation <br />concerns will result from the variance. The exempted road segments are of moderate <br />grade, will not result in blockage of any ephemeral, intermittent, or perennial <br />streams, and do not intercept any Large drainage areas. <br />Only one haul road reeuirement was not address~~,: uy the applicant. Rule 4.03.Z(1)(d) <br />requires that the applicant provide a haul road certification after construction. <br />Since this has not been addressed by the applicant, the following stipulation is <br />required: <br />Stipulation No. I' <br />[/ITH IN 90 DAYS AFTER PERMIT ISSUANCE, TRINIDAD BASIN i•fIN LNG SBALL <br />SUBPfIT TO THE DIVISIOJJ A CERTIFICATION DOCUMENT WNIC.H STATES THAT <br />ALL BAUL ROADS WERE CONSTRUCTED OR 12ECONSTRUCTED IN ACCORDANCE WITN <br />THE PLAN CONTAINED II1 THE APPROVED 1•ILRD PERMIT APPLICATION. THE D000- <br />MEP1T SHALL BE CERTIFIED BY A QUALIFIED REGISTERED PROFESSIONAL <br />ENGINEER. TNIS CERTIFICATION DOCUMENT IS ALSO REQUIRED TO BE <br />SUBMITTED AFTER COIJSTRUCTION OF ANY NEW NAUL ROARS AT THE P12NE. <br />With the acceptance by Trinidad Basin .Mining of the above stipulation, the operation <br />is in compliance with the requirements of this section. <br />XX, Bonding - Rule 2.05.4(2)(b) and Rule 3 <br />The Division has reviewed Section VIII of the permit application for compliance with <br />the requirements of this section. <br />The applicant has provided a scenario for the 'worst case` condition during this <br />permit term. The 'worst case` condition occurs when the amount of work required <br />to complete reclamation of the mine and Zoadout facilities is greatest. <br />
