Stipulation No. 16 <br />IN THE EVENT THAT THE AERIAL PHOTOGRAMMETRIC MONUMENT SURVEYS FAIL TO <br />MEET THE STIPULATED ACCURACY CRITERIA, MCC SHALL UTILIZE TRADITIONAL <br />FIELD SURVEY TECHNIQUES TO ESTABLISH THE REASONS FOR LACK OF <br />CORRELATION. IF THE RESULTS CANNOT BE CORRELATED, MCC SHALL RESUME <br />TRADITIONAL FIELD SURVEY MONUMENT MONITORING, IN COMPLIANCE WITH THE <br />ACCURACY CRITERIA AND STANDARDS CONTAINED WITH STIPULATION N0. 15. <br />STATUS: Forgiven <br />Stipulation No 17 <br />THE DIVISION DIRECTS MCC TO SUBMIT REPORTS OF ITS SUBSIDENCE MONITORING <br />PROGRAM ON A SEMI-ANNUAL BASIS, COMMENCING ONE MONTH AFTER THE <br />INSTALLATION AND INITIAL SURVEYING OF THE SUBSIDENCE MONUMENTS. FURTHER, <br />DUE TO THE COMPLEXITY OF THE PERMIT AREA, GEOLOGY, PRESENCE OF LANDSLIDES <br />AND STEEP SLOPES, AND SENSITIVE HYDROLOGIC ELEMENTS, MCC IS DIRECTED TO <br />SUBMIT A PROPOSED SUBSIDENCE MONITORING REPORT FORMAT TO THE DIVISION FOR <br />APPROVAL. THIS REPORT FORMAT SHOULD RECOGNIZE THE IMPORTANCE OF <br />CONTINUAL UPDATE OF SUBSIDENCE DATA INTERPRETATION, MONITORING OF GROUND <br />WATER LEVELS AND SPRING FLOWS, MONITORING OF MINE INFLOW, AND SUBSURFACE <br />GROUND CONDITIONS WHICH COULD BE CORRELATED TO SUBSIDENCE PREDICTION. <br />THIS REPORT FORMAT SHALL BE APPROVED BY THE DIVISION PRIOR TO THE <br />COMMENCEMENT OF EXTRACTION OF COAL WITHIN THE SUBSIDENCE TEST PANEL <br />DESIGNATED IN APPENDIX A TO MCC'S NOVEMBER 1984 PERMIT REVISION <br />APPLICATION (PANEL iW-15). <br />In a memo dated March 5, 1990 from Matthew Hayes, it was determined that this <br />stipulation could be terminated as of October 27, 1989, because it was <br />incorporated into the permit on page 3-78A. However, with the reorganization <br />of the permit (TR-59), this stipulation was not included. Page 2.05-147 was <br />updated to include this commitment but did not specify the approved format. <br />During the process of NOV C-93-006, it was determined that the format being <br />used for the reports was the approved format. <br />STATUS: Terminated <br />Stipulation No. 18 <br />THE DIVISION DIRECTS MCC TO COMPLETE A DETAILED ANALYSIS OF THE POTENTIAL <br />EFFECTS UPON THE SLOPE STABILITY OF THE LANDSLIDE DEPOSITS ADJOINING <br />BEAVER RESERVOIR. MCC SHALL INSTALL AND MONITOR AN APPROPRIATE SET OF <br />MONUMENTS ON THE LANDSLIDE DEPOSITS IN ORDER TO OBSERVE THE POTENTIAL <br />DISPLACEMENT OF THE LAND FORM. THE DETAILED ANALYSIS SHALL BE COMPLETED <br />AND SUBMITTED TO THE DIVISION FOR REVIEW, PRIOR TO REQUEST FOR APPROVAL <br />TO EXTRACT COAL BENEATH THE LANDSLIDE DEPOSITS ADJOINING BEAVER <br />RESERVOIR. <br />Because the permit area boundary still includes Beaver Reservoir and the <br />adjoining landslide deposits, the stipulation status will remain "future." <br />STATUS: Future <br />-6- <br />
