This summary was provided <br />to the Office of Mined Land Reclamation ("OMLR") on October 13, 1994 during a meeting <br />between CC&V and the OMLR and it was our understanding that Dr. Pendleton and probably <br />Mr. Sorenson were going to review it and judge the tests' adequacy in terms of reducing the <br />frequency of testing. This letter confirms the request in light of informally-transmitted <br />information suggesting that the OMLR was not yet comfortable with the information and that <br />the frequency could not be returned to that approved in the specifications. <br />The specifications require permeability testing pursuant to ASTM D5084/2434 at a frequency <br />of 1 test for every 15,000 yd'. CC&V committed to conduct additional testing in its letter of <br />April 19, 1994 and in its revised transmittal of April 26, 1994. That agreement stated "15. The <br />frequency of permeability testing for soil liner fill will be on test for each 5000 cubic yards of <br />fill until such time that the OMLR approves a lower frequency for testing. Proposals for such <br />approval would be based upon a demonstration of consistency in the initial results." I believe <br />that the OMLR staff members who were instrumental in evaluating the use of the Ironclad <br />material as a liner discussed the testing frequency many times with our agent, Golder Associates, <br />and that it was clearly understood that once the "consistency" was established, the frequency <br />would be brought back to that approved in the specifications. <br />The summary of the permeability measurements made to date clearly show consistency and, <br />most importantly, show a much lower permeability than is required by the specification (10-6 <br />cm/sec is required by the specifications). The range in tested permeabilities is from 1x10-9 to <br />8x10-9 cm/sec. Not a single measured permeability has been in the 106 cm/sec range -all have <br />
