Box 1425 <br />Durango, Colorado 81301 <br />RE: Blue Flame Mine, File No. C-81-053 <br />Dear Mr. Lobato: <br />As you may be aware, some confusion has arisen recently regarding the surface <br />ownership of the lands within the Blue Flame Mine permit area. The lands are <br />specifically described as lying within the NW 1/4 NE 1/4 and the West 400 feet <br />of the NE 1/4 NE 1/4 of Sec. 31, T35N, R11W, of the New Mexico Principal <br />Meridian. <br />Page 2.03.4 of the permit application lists P1r. Jack Wiltse and the Ute <br />Mountain Ute Tribe as surface owners of the area in question. Map A-1 <br />indicates the Ute Mountain Utes own the entire area, while the published <br />newspaper notice lists the Ute Mountain Ute Tribe and Mr. Lawrence Huntington <br />as surface owners. <br />Please provide an explanation for the apparent discrepancies and submit a <br />revised land ownership map, a title to the property contained with the permit <br />boundary, and a replacement page which lists the current legal surface owners <br />of land within the permit area, as soon as possible. <br />Please contact me if you have any questions. <br />Sincere, _ <br />w~ l~ r ~-.'/i <br />Dan T.
