The lessee will obtain a written agreement from all right-of-way grantees <br />for permission to conduct mining and associated operations within the area <br />of their right-of-way or for relocation of the right-of-way to the satis- <br />faction of the grantee. If it is necessary to relocate a right~f-way or <br />easement, consultation shall take place between the right-of-way holder <br />and the lessee. All costs involved in the location will be borne by the <br />lessee and a copy of this agreement will be furnished to the BLM. <br />2. Where underground mining is to take place, monitoring for impact to known <br />site locations will be required in those areas where subsidence has been <br />determined to be occurring, or where there is a possibility that it may <br />occur. Areas to be monitored and schedule of monitoring will be <br />delineated by OSt92E in consultation with BLH, the SHPO, and company. All <br />monitoring of sites is to be carried out by a qualified archaeologist. If <br />subsidence is determined to be affecting cultural resources, OSMRE will be <br />notified and appropriate measures will be taken in consultation with BLH <br />and the SHPO to mitigate its effect. <br />3. If subsidence is found to be occurring in areas that have not been inven- <br />toried for cultural resources, OSMRE in consultation with BLM and the SHPO <br />may require further inventory of the areas under 36 CFR 800.4(x). <br />4. No surface facilities or mine-related surface activities are permitted <br />without a special written waiver from OSlIItE and the BLM's authorized <br />representative in the following areas: <br />T. 10 S., R. 98 W., 6th P.M. <br />Sec. 20: S1/2, S1/2N1/2 <br />Sec. 21: S1/2, S1/2N1/2 <br />Sec. 22: SW1/45E1/4, S1/251/2SW1/4 <br />Sec. 26: ES/2 <br />Sec. 35: S1/2NE1/4, SE1/4NW1/4, SE1/4, E1/2SW1/4 <br />T. 11 S., R. 98 W., 6th P.M. <br />Sec. Any expansion of surface disturbance shall be preceded by a survey <br />acceptable to BLM's Authorized Representative to determine the locations <br />of Uintah Basin hookless cactus. If activity approaches within 1/2 mile <br />of cliffs, the location or absence of nesting falcons (other than <br />kestrels) during April 15 to July 15 must be documented. <br />
