This action is taken consistent with the permit regulations due <br />to information from the Colorado Mined Land Reclamation Division that the mine <br />site has been abandoned. Mined Land has revoked the mining permit for this <br />site and is in the process of getting the bond money to begin reclamation of <br />the site. The permit is currently suspended for nonpayment of the annual <br />administration tees; and further, several pieces of mail sent to the permittee <br />from this Division have been returned unclaimed. <br />We remind you that it is unlawful to discharge pollutants from a point source <br />to state waters without a permit. Section 25-8-608 of the Water Quality <br />Control Act provides for civil penalties of up to E10,000 per day for unlawful <br />discharge. Should you operate your facility, now or in the future, you will <br />need to apply for a permit no less than 180 days prior to any discharge. <br />Should you have any questions regarding this matter, please call this office <br />at (303) 331-4590. <br />sincerely, <br />Robert J.
