Cepartment of Natural Resources, State of Cclorado. <br />R~~jiAL~ <br />I. Colorado Westmoreland Inc_____ ("operator") desires to <br />conduct a mining operation known as Orchard vall~ Mine ___________ <br />for the purpose of extracting coal. <br />II. Cn S~tember24 ___, 1981_, the Mined land Reclamation <br />Division ("the division^) apprcved operator's application <br />for this permit, fixed the amount of bond and directed that <br />this permit be issued upon the filing with the division of <br />bond in the amount so fixed in corm and substance approved <br />by the division, and such bona has been so furnished. <br />II[. On S~tember~____. 1981_, the division made the fol- <br />lowing findings: <br />a) The permit application is accurate and ccntains <br />all information required under i,.R.S. 1973. 34-33-1%1 QS <br />S,~a. and regulations promulgatztl thereunder and that all <br />the requirements of article 33 of title 34r C.R.S. 1973 <br />("such article") for the issue of a permit have been cempl;ed <br />with; <br />D) The applicant has demonstrated that reclamation <br />as required by such article can be accomplished under the <br />reclamation plan contained in the permit application; <br />c) The assess,nent of the probable cumulative impact <br />of all anticipated mining in the area on the hycrolugic bal- <br />ance specified in section 34-33-110(2) (1) has been made uy <br />the dlVlslon and the prOpOSed CperdtiOn thereof hds Deen <br />designed to prevent material damage to hydrelogic balance <br />outs;de the permit area; <br />d) Granting the permit will not conflict with any <br />designation decision issued pursuant tc section 522 of the <br />federal "iurface ;Aininy Contrcl and Reclamaticn Act of 1977", <br />as amended, (P.L. 9i-37), nor is the area proposed to be <br />mined within an area under study for unsuitaCility resigna- <br />tion in an administrative proczeding commenced pursuant to <br />section 34-33-126 or section 52Z of said P.L.
