As we discussed with you and a representative of <br />the Attorney General's Office, Cotter will continue as the operator of the Schwartzwalder <br />Mine and will remain the named licensee or permittee on each of its authorizations from <br />the Division of Minerals and Geology. Currently, the record title holder of the surface <br />estate and certain mineral rights at the Schwartzwalder mine, Commonwealth Edison <br />Company of Illinois ("Commonwealth"), will transfer title of said surface estate and <br />mineral rights to Cotter as part of the transaction.
