We aze <br />looking forward to working with your group on bond release submittals. We would like to verify our understanding of <br />specific issues that were discussed with you and Mike Boulay. <br />SCC expects to submit a Phase I bond release package for Seneca II in eazly 2006, based on tdamation that <br />needs to be completed (roads and drainages), public notice timeframes, and the Division's bond release field <br />inspection. The Phase I Bond Release format and documentation will be based on the: <br />1. Guideline Regarding Selected Coal Mine Bond Release Issues, Apri118, 1995; <br />2. Rule 3.03 Release of Performance Bondr, and <br />3. The issues addressed in the]uly 19~^ meeting. <br />• The entire Seneca II mine will qualify for Phase I bond release, except for the facilities and office azea. <br />• SCC will attempt to designate lands, based on their law status and bond designation. <br />• The postmine drainages will require `as-built profiles' except for PM-1, which will require afull-blown certified <br />as-built. These will be submitted with the bond release package. <br />• Roads that retnain will be built into the post tnining topography. Roads will have a `typical as built', consisting - - <br />ofcross-sections and profiles, included in the package. <br />- Roads in excess of 20 feet will have a justification for their need. <br />- Reclamation adjacent to the permanent roads will be seeded without topsoil. <br />• The CDMG will receive a draft of the public notice letter prior to it being finalized and sent. At that time, a list <br />of the recipients will be submitted to the CDMG. <br />• SCC will send the bond release package to your office before the public notice period has expired. <br />• SCC will submit a Technical Revision for Vegetation Evaluation Procedures, prior to submitting a Phase R <br />package. <br />Seneca Coal Company • P.O.
