Vegetation - Rules 2.09.10, 2.05.4(2)(e) and 4.15 <br />The permit area at the Blue Ribbon Mine is comprised of the following plant <br />communities, as shown on Exhibit E and described on pages 62-66, Section <br />2.04 of the permit application: 1) Oak shrub community (west aspect); <br />2) Oak shrub community (east aspect); 3) Oak shrub-mountain mahogany, and <br />4) Riparian. The shrub communities are found on the steep slopes and the <br />riparian community is located along the Hubbard Creek drainage. The area <br />disturbed by the mining operation constitutes 20.48 acres of the permit <br />area along Hubbard Creek and adjacent to the valley bottom. No additional <br />surface disturbances are proposed. <br />No threatened or endangered plant species have been identified in the permit <br />and adjacent area; consequently, there is no known potential for impact to <br />their existence of endangered or threatened plant species or result in the <br />destruction or adverse modification of their critical habitats as determined <br />under the Endangered Species Act of 1973 (16 USC Sec. 1531 et seq.) or the <br />Non game, Endangered or Threatened Species Conservation Act (Section 33-8-101 <br />et seq., C.R.S. 1973). <br />The revegetation plan for the Blue Ribbon Mine can be found on pages 111-113ii, <br />Section 2.05 of the permit application. Two plant communities will be reestab- <br />lished on the disturbed areas following termination of mining activities: 1) <br />A shrub community on the uplands and steep slope areas, and 2) A riparian <br />community along the more level valley bottom and stream channel embankments. <br />The post-mining vegetation configuration is depicted on Exhibit Q. Pursuant <br />to Rule 4.I5.7(2)(d)(vi), Blue Ribbon Coal Company requested that the Division <br />set standards for re-vegetation success based upon Local environmental conditions <br />and available data for similar sites. The standards recommended by the Division <br />were accepted by the applicant, and are listed on page 113 of the permit appli- <br />cation. All concerns pertaining to vegetation which were raised in the Divi- <br />sion's April 23 and December 4, 1981 Preliminary Adequacy Reviews of the Blue <br />Ribbon Mine permit application have been satisfactorily resolved, and the appli- <br />cation is in compliance with the requirements of this section. <br />XII. Fish and wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />The fish and wildlife information and the mitigative actions detailed in the <br />permit application may be found on pages 67-96, Fish and Wildlife Information, <br />Appendix B Latilong Species Printout, and pages 118-120 Wildlife Mitigation <br />Plan. <br />The area of the surface disturbance at the Blue Ribbon Mine encompasses <br />approximately 20 acres of the steep southcrest facing slope of Hubbard Creek <br />Canyon. No additional disturbance is proposed for the life of the mine. <br /> <br />
