-9- <br />Legal, Financial, and Compliance Information (con't) <br />Pursuant to Rule 2.07.6(2)(h), the Division finds that Blue Ribbon Coal Com- <br />pany does not control and has not controlled any mining operations with a <br />demonstrated pattern of willful violations of the Act of such nature, dura- <br />tion, and with such resulting irreparable damage to the environment as to <br />indicate an intent not to comply with the provisions of the Act. <br />The application is in compliance with the requirements of this section. <br />II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br />Prior to the submittal of this application, the predominant land use classi- <br />fications on the proposed permit area were: 1) Undeveloped land for wildlife <br />habitat, limited livestock grazing and outdoor recreation, and 2) Previously <br />disturbed land for the purpose of mining coal. Aland use map is provided as <br />Exhibit K, and a discussion of existing land uses can be found on pages 16 and <br />27 within Section 2.04 of the permit application. After the completion of <br />mining, Blue Ribbon Coal Company plans to return the land to the pre-mining <br />Land use of wildlife habitat. Postrv Wing land uses are discussed on page 117 <br />of Section 2.05, and are delineated on Exhibit L, Post~~ing Land Use Map of <br />the permit application. <br />It has been determined that the proposed postminin9 land use of wildlife <br />habitat satisfies the requirements of Rule 4.16. Pursuant to 2.07.6(2), the <br />Division hereby approves the postmining land use. <br />The application is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2.09.4 and 2.05.6(4) <br />Cultural and historic resources information, including a resource survey con- <br />ducted by Centuries Research, Inc. during October 1977, is presented on pages <br />18-20, Section 2.04 of the Blue Ribbon Mine permit application. <br />On the basis of evidence submitted by Blue Ribbon Coal Company in the form of a <br />letter from the State Historical Preservation Officer included as page 20i within <br />the permit application, the Division finds that the proposed mining operation <br />will not adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. (2.07.6(2)(e)). <br />Although not required by Colorado regulations, within the Federal regulations <br />there is a further consideration of "cultural or historic resources eligible <br />for listing on the National Register of Historic Places." For information <br />concerning this requirement, please refer to the Cultural and Historic Resources <br />section of the Office of Surface Mining's Environmental Analysis for the Blue <br />Ribbon Mine. <br />The application is in compliance with the requirements of this section. <br /> <br />
