The exact number of surface acres which have been affected in the permit area is
1876. The attached shows the aerial extent of the No.6 mine workings as of the time of
temporary cessation.
2. Presently, the mine is not planning to conduct any reclamation activities as Empire is
optimistic that mining will resume once market conditions prove favorable. Therefore,
the reclamation which will have been accomplished through the date: of cessation, per
annual reclamation reporting, remains at 294 acres.
3. As stated in response number 2, Empire is not planning to conduct any reclamation
activities at its surface facilities. The approved backfilling, grading and revegetation
plan will be followed at such time as final reclamation occurs. Empire will continue with
its approved hydrologic monitoring plan, except for the alluvial wells which were
required for the extension of the mains. This extension has not occurred; therefore,
Empire has not installed the wells. Prior to resuming the mains extension the wells will
be installed as per the approved plan. The waste water treatment ,system continues to
be used to treat the effluent generated by the limited personnel at f:he site. Likewise,
the water system continues to be used by the employees. Empire is reviewing the
current monitoring plan to determine if changes can be made to it. Once a revised plan
is developed a revision will be submitted to the Division detailing these changes.
4. The reason for the temporary cessation lies in the competitive nature of the coal
industry. The market place is extremely competitive, and Empire is forced to wait for
