<br />5 <br />The Division proposed to approve a Phase II/III application for Block C, SL-03, on <br />October 31, 1996. The Block C approval will reduce the bond $34,600 to $8,845,400. <br />This reduced amount of bond held by the Division following the release of Block C bond <br />monies is significantly in excess of the amount necessary to revegetate the entire site, <br />reclaim three sediment ponds (ponds H, M, and K), and topsoil and re-seed the 5 acre <br />area at the dragline dismantling site. <br />An application for Phase I bond release, SL-O5, was received by the Division on August <br />15, 1996. The application was deemed complete on September 4, 1996, after the Division <br />received proof of publication of the applicant's public notice. Colorado Yampa Coal <br />Company published notice of the bond release application in the Steamboat Pilot once <br />weekly for four consecutive weeks, beginning July 25, 1996. Colorado Yampa Coal <br />Company also notified land owners within and adjacent to the mine permit azea, and other <br />interested parties of the application for bond release, as required by Rule 3.03.2(1). <br />No comments, written objections, or requests for an informal conference regazding the <br />bond release application were received by the Division. <br />Review of the area requested for release found that the requested acreage was in error. <br />The operator requested a release of 810 acres. The operator did not submit a map clearly <br />showing which areas were included in this request. The Division's finding on acreage not <br />included in the 1988 phase I bond release for mine plan areas 51 and 61 totals 601 acres. <br />The Division believes the discrepancy in acreage (810 acres vs 601 acres) originates from <br />the operator including mine plan area 51 acreage which previously received phase I <br />release. This bond release application, SL-O5, will consider those portions, 601 acres, of <br />areas 51 and 61 which were not included in the 1988 Phase I bond release. Due to this <br />discrepancy the Division shall attach Stipulation No. 26 to the permit: <br />STIPULATION NO. 26 <br />COLORADO YAMI'A COAL COMI'ANY SHALL SUBMIT, BY JANUARY 10, 1997, <br />A MAP OF THE ECKMAN PARK, MINE 1 AND 2 MINES, ACCURATELY <br />DEPICTING LOCATION AND ACREAGES OF MINING AREAS AND BOND <br />RELEASE BLOCKS. THIS MAP SHALL REFLECT PHASED RELEASES AND <br />DATES OF SURETY RELEASE FOR THE ASSOCIATED AREAS. <br />The Division scheduled and conducted a bond release inspection on October 7 and 8, <br />1996. The site inspection was conducted in accordance with Rule 3.03.2(2). The <br />inspection was conducted 33 days after the Division found the bond release application <br />release. The extension beyond the 30-day time period noted in Rule 3.03.2(2) was <br />necessary due to scheduling conflicts between interested parties, Parties in attendance <br />during the bond release inspection included representatives from the Division of Minerals <br />and Geology, representatives from the Office of surface Mining-Denver Field Division, <br />
