The lessee, before issuance of the mine permit, will conduct and provide to BLM an inventory of all <br /> existing state adjudicated water r jnts i, and adjacent to the lease tract which may be impacted by <br /> subsequent mining activities. At a minimum, this inventory will include: the water right holder, location, <br /> source, amount of decree, beneficial use, historical flow, and the appropriation and adjudication dates. <br /> Existing cross-tract and on-tract water flows shall be maintained by the lessee even following release of <br /> the permit bond by the Colorado State Mined Land Reclamation Board. Compliance with this mitigation <br /> shall be assured by an increase in the BLM administered lease bond for a monetary amount and for a time <br /> period to be determined in consultation with state and federal authorities, affected water users, and the <br /> lessee. <br /> The following issues will be looked at during the mine plan stage: <br /> With respect to bald or golden eagle nests which may be established on the review area during the life of <br /> the project, the following shall be applied. No new permanent surface facilities or disturbances shall be <br /> located within a 1/4 mile radius buffer zone around each bald or golden eagle nest site. No surface <br /> activities will be allowed within a 1/4 mile radius buffer zone around each eagle nest site from March 1 to <br /> July 1. Any proposed activities in, or adjacent to, these buffer zones (except routine maintenance) will <br /> require approval from the BLM, on a site-specific basis, after consultation with the U.S. Fish and Wildlife <br /> Service. <br /> To protect and preserve breeding and nesting habitat for the Loggerhead shrike, disturbances in sagebrush <br /> and oak stands should be avoided to the extent possible. <br /> The above mitigating measures were identified in the EA. Any additional measures necessary will be identified and <br /> dealt with at the time the Mine and Reclamation Plan Permit Application is approved. <br /> Monitorina: Aside from monitoring done by the lessee, all surface disturbing and mining activities on the lease will <br /> be monitored by the Office of Surface Mining, Colorado Mined Land Reclamation Division and BLM during the mine <br /> and reclamation plan permitting process. <br /> • :onclusion: We recommend that the land identified in coal lease application, C0053356, as modified by the <br /> Roatcap Creek Coal Tract, be offered for competitive lease so that the mining of the D coal seam may occur. <br /> Based on the analysis of potential environmental impacts contained in the attached environmental assessment, we <br /> have determined that the impacts are not expected to be significant and the action is not highly controversial. <br /> Therefore, the preparation of an environmental impact statement is not required. <br /> We recommend the lands identified in Roatcap Creek Coal Tract, C0053356, be offered for competitive lease sale. <br /> Area Manager Date <br /> District Manager Date <br /> I approve the recommendation in this report as the decision of the BLM on this proposed action. <br /> . ite Director Date <br /> 2 <br />
