• The proposed area of mining plan approval is not unsuitable for mining according to section 522 (b) of SMCRA. The mining plan modification area is not on any Federal lands within the boundaries of any national forest. I have determined that approval of this mining plan modification will not have a significant impact on the quality of the human environment. The environmental analysis prepared by BLM and OSM and entitled "National King Coal, Inc., Coal Lease Application; 7 South Mains Tract; COC-60941; Environmental Assessment CO-038-97-53" noted in the Finding of No Significant Impact (FONSI), describes the impacts that may result from approval of this mining plan modification and its alternatives. The FONSI and supporting environmental analysis are included in this decision document. OSM's review of the proposed action did not identify any issues that required resolution via the addition of special conditions to the mining plan approval. However, DMG approved the SMCRA permitting action for Permit Revision No. 6 on July 15, 1998, before the permittee had obtained the right to enter on Federal lease COC-60941. The DMG • subsequently stipulated on August 25, 1998, its decision that mining could not proceed until the Federal lease was obtained. The Federal lease was issued on October 1, 1998 and the permittee complied with the stipulation on October 30, 1998. Subsequently, DMG issued a revised decision document on November 5, 1998. OSM based this mining plan decision on the November 5, 1998, DMG decision document. Publication of four consecutive weekly notices in the Durango Herald newspaper notified the public of the availability of the administratively complete PAP for review. The last publication date was November 29, 1997. No public comments on the PAP were received after the public notice was published. The DMG determined that a bond for $120,000 is adequate for the Colorado Permit No. CO-81-035 associated with this mining plan modification. The bond is payable to the State and the United States. A chronology of events related to the processing of the PAP and this mining plan decision is included with the decision document. The information in the PAP, and other information identified in the decision document, has been reviewed by DMG staff in coordination with the OSM Project Leader. • OSM's administrative record of this mining plan modification consists of the following:
