• The proposed area of mining plan approval is not unsuitable <br />for mining according to section 522 (b) of SMCRA. <br />The mining plan modification area is not on any Federal <br />lands within the boundaries of any national forest. <br />I have determined that approval of this mining plan <br />modification will not have a significant impact on the <br />quality of the human environment. The environmental <br />analysis prepared by BLM and OSM and entitled "National King <br />Coal, Inc., Coal Lease Application; 7 South Mains Tract; <br />COC-60941; Environmental Assessment CO-038-97-53" noted in <br />the Finding of No Significant Impact (FONSI), describes the <br />impacts that may result from approval of this mining plan <br />modification and its alternatives. The FONSI and supporting <br />environmental analysis are included in this decision <br />document. <br />OSM's review of the proposed action did not identify any <br />issues that required resolution via the addition of special <br />conditions to the mining plan approval. However, DMG <br />approved the SMCRA permitting action for Permit Revision No. <br />6 on July 15, 1998, before the permittee had obtained the <br />right to enter on Federal lease COC-60941. The DMG <br />• subsequently stipulated on August 25, 1998, its decision <br />that mining could not proceed until the Federal lease was <br />obtained. The Federal lease was issued on October 1, 1998 <br />and the permittee complied with the stipulation on October <br />30, 1998. Subsequently, DMG issued a revised decision <br />document on November 5, 1998. OSM based this mining plan <br />decision on the November 5, 1998, DMG decision document. <br />Publication of four consecutive weekly notices in the <br />Durango Herald newspaper notified the public of the <br />availability of the administratively complete PAP for <br />review. The last publication date was November 29, 1997. <br />No public comments on the PAP were received after the public <br />notice was published. <br />The DMG determined that a bond for $120,000 is adequate for <br />the Colorado Permit No. CO-81-035 associated with this <br />mining plan modification. The bond is payable to the State <br />and the United States. <br />A chronology of events related to the processing of the PAP <br />and this mining plan decision is included with the decision <br />document. The information in the PAP, and other information <br />identified in the decision document, has been reviewed by <br />DMG staff in coordination with the OSM Project Leader. <br />• OSM's administrative record of this mining plan modification <br />consists of the following: <br />
