This letter was written to Mr. Shrestha on behalf of Mr. Phil Bunker, notifying Western Fuels of drywall damage that has occurred to Mr. Bunker's residence at 535 Grape Street in Nucla, Colorado. Upon receipt of your letter, Mr. Harry Ranney of our office conducted athree-way telephone conversation yesterday with you and Mr. Bunker. It is my understanding that Mr. Bunker verbally requested the Division to conduct an on-site investigation of this matter. The Division will be pleased to comply with this request. We must first, however, receive a written request for such an inspection, pursuant to Section 5.02.5 of the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining (a copy of Section 5.02.5 is enclosed). Upon receipt of the written request for inspection, the Division must then evaluate whether the request gives the Division sufficient basis to believe a violation of the Colorado Surface Coal Mining Reclamation Act, the Board's Regulations or the New Horizon Mine Permit has occurred (Sections 5.02.5(1)(a) and (1)(b}). iii-ii~iiiiiiiiiiii STATE OF COLOR~vv Should the Division determine that sufficient basis for conducting an inspection exists, the Division, pursuant to Section 5.02.5(3), will notify Mr. Bunker of the date and time of our inspection, and proceed with the inspection.
