This letter was written to <br />Mr. Shrestha on behalf of Mr. Phil Bunker, notifying Western Fuels of drywall damage that has <br />occurred to Mr. Bunker's residence at 535 Grape Street in Nucla, Colorado. <br />Upon receipt of your letter, Mr. Harry Ranney of our office conducted athree-way telephone <br />conversation yesterday with you and Mr. Bunker. It is my understanding that Mr. Bunker <br />verbally requested the Division to conduct an on-site investigation of this matter. <br />The Division will be pleased to comply with this request. We must first, however, receive a <br />written request for such an inspection, pursuant to Section 5.02.5 of the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining (a copy of Section 5.02.5 is <br />enclosed). <br />Upon receipt of the written request for inspection, the Division must then evaluate whether the <br />request gives the Division sufficient basis to believe a violation of the Colorado Surface Coal <br />Mining Reclamation Act, the Board's Regulations or the New Horizon Mine Permit has occurred <br />(Sections 5.02.5(1)(a) and (1)(b}). <br />iii-ii~iiiiiiiiiiii <br />STATE OF COLOR~vv <br />Should the Division determine that sufficient basis for conducting an inspection exists, the <br />Division, pursuant to Section 5.02.5(3), will notify Mr. Bunker of the date and time of our <br />inspection, and proceed with the inspection. <br />
