My inspection of the Farnsworth gravel operations along <br />the North Fork of the Gunnison River revealed that all their current activities are permitted <br />through mining and reclamation permits and that their activities are in compliance with our <br />Minerals Rules and Regulations and the Colorado Mined Land Reclamation Act 34-32-101 <br />Et. Seq., C.R.S. 1973. Further, I will attempt to address your concerns in the order in <br />which they were listed. <br />1. Farnsworth Construction Co. operates both the Bingham Crushing Pit, File No. <br />M-82-154 on the south side of the Gunnison River and the River Bottom Gravel Pit, <br />File No. M-92-100 on the north side of the Gunnison River. Both sites are in <br />compliance and are adequately bonded for reclamation. River Bottom Land <br />Corporation is the owner of the land in question. Farnsworth Construction leases the <br />property for mining purposes. <br />2. Farnsworth Construction has used a culvert in years past to serve as a low water <br />crossing. The culvert has been removed at the end of each mining season, prior to <br />peak flow in the spring. Farnsworth Construction will be required to have an <br />application for a 404 Permit on fde with the U.S. Army Corps of Engineers by <br />August 25, 1994 for all activities within the river channel. <br />3. Farnsworth Construction has operated their crusher facilities from 7-10 p.m. only <br />during emergency situations, and upon the consent of the neighbors to the west <br />operating Redwood Arms Motel. Crushing operations normally end prior to <br />7:00 p.m. <br />
