Box 535 <br />Somerset, Colorado 81434 <br />Re: Request for Fugitive Particulate Emissions Control Plan <br />Gentlemen: <br />Your attention is directed to the Colorado Air Ouetity Control Commission's <br />Regulation Number 1, Section III.D.(a copy is enclosed), and specifically <br />Section III.D.1.a(i), which reads as follows: <br />"Every owner or operator of a source or activity which is subject to <br />this Section III.D. shall employ such control measures and operating <br />procedures as are necessary to minimize fugitive particulate emissions <br />into the atmosphere through the use of all available practical methods <br />which are technologically feasible and economically reasonable and which <br />reduce, prevent and control emissions so as to facilitate the <br />achievement of the maximum practical degree of air purity in every <br />portion of the State." <br />Your attention is further directed to Regulation Number 1, Section <br />III. D.2.d.(ii), which reads as follows: <br />"Any owner or operator of any new or existing mining operation from <br />which fugitive dust particulate emissions will be emitted shall be <br />required to use all available, practical methods which are <br />technologically feasible and economically reasonable in order to <br />minimize such emissions in accordance with the requirements of Section <br />III. D., of this Regulation." <br />An invest igation resulting from complaints received by this Division <br />concerning coal dust from the Somerset Mining Company operations at Serller~et, <br />Colorado was conducted. The investigation revealed excessive amounts of coal <br />dust covering the buildings and yards within the town of Somerset. Evidence <br />of coal was noted in multiple layers in the snow accumulated on roofs.
