Larson, President
Kerr Coal Company
3 Park Central, Suite 900
1515 Arapahoe
Denver, Colorado 80202
Dear Jim:
I am in receipt of your letter of April I5, 1981 addressed to the Governor
as well as the letter of April 17, 1981 from Mr. Michael S, McCarthy, to
Dave Shelton of the Mined Land Reclamation Division. As a result of
discussions with Dave it is my understanding and his that Kerr Coal
Company does not plan on altering your approved permit at this time.y in
any way except for a slow-down in the sequence of events., This proposal
does not cause any apparent problem as Long as~the plari~~is~being followed
and you are in compliance with the performance standards of the Law,
regulations and your permit.
If however you will need some changes to your permit to accomodate this
slow-down, I urge you to submit this request to the Mined Land Reclamation
Division at the earliest possible time so as to avoid a situation where
the Division will not be able to act within a short time frame that you
may believe is necessary.
. -.. I
I hope that you will be able to solve yo urnmarketing problems in the
near future so that the operation may return to normalcy for you and
your employees in Jackson County.
Sincerely,
D.
