Box 534 M,rn,els Lnng <br />Somerset, Colorado 81434 Dim Sion D^eaor <br />RE: Sanborn Creek Mine; Our File No. C-81-022; Notification of <br />Underground Mining <br />Dear Mr. Larson: <br />Per our conversation on May 1, 1996, I am enclosing portions of the <br />"Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining" as they pertain to landowner notification and subsidence <br />control. Mining companies are required to notify property owners <br />and residents of land, within the area above the underground <br />workings and adjacent areas, six months prior to mining beneath <br />that property (Rule 4.20.2). The letter that you received from <br />Oxbow Carbon and Minerals is in fulfillment of that requirement as <br />an adjacent property owner. <br />Although we have not yet received an application to mine the area <br />in question, it is my current understanding that the mining will be <br />no closer than about one-half mile to the west of your property. <br />Given this proximity, it is unlikely that any adverse surface <br />impacts would occur on your property, hence the comment that "no <br />special or unusual measures will be taken to prevent or control <br />adverse impacts". However, once the Division receives a revision <br />to the existing Sanborn Creek Mine permit that clearly illustrates <br />the proposed expansion, a through review of the expected surface <br />impacts as a result of undermining will be conducted by our office. <br />If we determine that potential impacts could occur, the operator <br />may be required to implement preventative measures to control <br />subsidence. <br />For your information, whenever an application to significantly <br />modify any existing permit is submitted to the Division, there is <br />ample opportunity for the public to review and comment on the <br />application and the Division's decision concerning that <br />application. Notice of permitting actions for mines located in <br />your area are published in the Delta County Independent and include <br />review and comment periods, locations where the applications can be <br />reviewed, and addresses where comments should be sent. <br />
