Apex No. 2 Mine; Midterm Findings
9. Sunland discusses the vegetation success data collection methodology on page 184-15 (revised
6/10/98). This page states that production data will be sepazated by life form: perennial grass,
perennial forbs, annuals and noxious species. Please indicate how Sunland proposes to treat biennial
species. Will they be combined with annuals or measured separately?
10. Attached aze recent printouts from the State Engineer's office of well permits and water rights
surrounding the permit azea of the Apex No. 2 Mine. To ensure compliance with Sections
2.04.7(1)(b) and 2.04.7(2)(a), please update Map Exhibit page 57.2 in the permit, and accompanying
pages, to show any wells and water rights shown on the printouts that are not shown on page 57.2.
11. Attached is a copy of a memo dated 11 /29/00 to the Division's Annual Hydrology Report file
concerning the Apex No. 2 Mines potential for dischazging mine water into bedrock aquifers. The
memo explains that it is probable water will discharge from the workings of the mine and form a
plume downgradient from the mine in a sandstone bed within the basal Williams Fork formation
aquifer. The plume would take a few hundred yeazs to expand out into an approximate 8-acre area
down-gradient from the workings where the aquifer is within economic drilling depths for water
wells. Sump water quality reported in the Apex No. 2 Mine indicates the plume would not cause
material damage to the aquifer. Please, either, add a page to the probable hydrologic consequences
section of the permit that predicts this plume and explains your basis for the prediction, or provide
the Division an explanation of why you believe such a plume will not form.
VI. Bonding Summary:
The Division holds a bond in the amount of $172,020.00 for reclamation liability at Apex No. 2 Mine.
This bond is drawn on Travelers Casualty and Surery Company, of Hartford, Connecticut, bond no.
64S 100507892BCA.
A phase I bond release for the backfill and grading of Apex No. 2 Mine was approved January 29, 1996.
The Phase I approval reduced the required bond amount for the Apex No. 2 Mine from $172,020.00 to
$68,808.00.
Please submit updates and revisions to bring the information in the permit up to date.
