Box 400, 1038 Montana <br />Nucla, CO 81424 <br />I~~~~ <br />DEPARTMENT OE <br />NATURAL <br />RESOURCES <br />Roy Romer <br />Governor <br />IamesS La hhead <br />E.ec uti ve Dircv:wr <br />enichacl B Long <br />Drv Isom Director <br />RE: Results of the Blasting Program Inspection at New Horizon Mine <br />Dear Mr. Belden: <br />As a result of your request, the Division conducted an extensive <br />review of the New Horizon Mine's blasting procedures and records to <br />determine if the cracks that are appearing in drywall of your <br />living room are a result of improper blasting methods at the mine. <br />The mine sets out four seismographs to record the maximum peak <br />particle velocity (PPV) and maximum airblast for each blast <br />conducted at the mine. The regulations state that the maximum PPV <br />for structures between 301-5000 ft. distance from the blast is <br />1.00"/sec and the maximum airblast recorded at 2 Hz cannot be above <br />133 dBL. The mine has detailed records of every blast and in no <br />instance did any of the blasts exceed the statutory requirements. <br />In fact, the reports indicate that the average PPV for blasts <br />monitored at or near your home was between .04 to .11 in/s, well <br />below the 1.00 in/s required by our regulations. As we discussed <br />at your home, the mine has proof that it has met all the legal <br />requirements for its blasting program and cannot be held liable for <br />the damage to your home. <br />Due to the results of this inspection, the mine will not be issued <br />a Notice of Violation for it's blasting program. Please be aware <br />that you have the right to request in writing that the Division <br />Director conduct an informal review of this inspection if you so <br />desire. <br />If you have any questions regarding this matter, please give me a <br />call. <br />Sincerely, <br />~~,~~.~ <br />Harry B.
