RE: Midterm Review, Eckman Park, Mine 1 and Mine 2, $C-81-071
Dear Mr. Mills:
Pursuant to Rule 2.08.3(1), "The Division shall review each permit
issued and outstanding under these rules not later than the
middle of the permit term " After this review, the Division
may require revisions or modifications to the permit to ensure
continued permit compliance. Additionally, pursuant to Rule
3.02.2(4), "The Division shall review the amount of bond required
for a permit area and the terms of acceptance of the bond at the
time permit reviews are conducted under 2.08.3 ."
The Eckman Park, Mine 1, and Mine 2 Permit was originally issued on
December 14, 1981 for a five-year term. The permit expiration date
was therefore December 14, 1986. Permit Renewal ~1 (RN-01) was
initiated on time; however, the process did not end until December,
1987. The renewed permit was incorrectly given an issuance date of
December 14, 1987, and an expiration date of December 14, 1992.
This discrepancy was corrected during Permit Renewal f2 (RN-02)
when the permit was back-dated to begin on December 14, 1991 and
expire on December 14, 1996. We are now at the midterm of the
current permit.
This midterm review consisted of reviewing the permit application
document, findings document, stipulation responses, revisions to
the permit, monitoring reports, and inspection reports. The
enclosed document is the Division's mid-term review of this mine.
