During the time the permit was being revoked <br />and the bond forfeited, an individual acquired the parcel of land comprising <br />the East mine area of the Hawk's Nest Mine by purchasing the delinquent tax <br />notice from the Gunnison County Assessor's Office for 410,148.13 on November <br />28, 1988. The Tax Notice listed the value of the land and improvements at <br />5816,750.00 with the improvements (wash plant, bldgs„ etc.) probably <br />constituting a majority of the value in the Droner±v. Due to the Division's <br />reclamation efforts, all of the structures, facilities, and equipment <br />remaining on the site have been demolished and removed. <br />The purchaser of the Drooerty, Mr. Russel Brown, has written a letter to the <br />Division (cony attached) informing us of his Durchase and asking for <br />information regarding the regulations pertaining to the property. The <br />Division responded with a letter to td r. Bro>.+n on August 30, 1991 explaining <br />the basics of the permit revocation/bond forfeiture process and recommending <br />that Mr. Brown contact you in order to beq~n resolving the problem. <br />In order to provide you with some background information, I have researched <br />the files and out together the following chronology: <br />9/12/88 - MLRD Notice of Permit Renewal Denial Decision sent to local <br />newspaper (North Fork Timesl, <br />9/15/88 - MLRD Notice of Permit Renewal Denial Decision sent to Gunnison <br />County Board of Commissioners, <br />11/15/88 - Board Nearing - Permit Renewal Denial (continued to December), <br />11/28/88 - Tax Lien on East Mine property purchased by R. Brown. <br />12/la/88 - Board Hearing - Permit Renewal Denial - Denial Upheld, <br />1/6/89 - Formal Board Order to revoke permit, forfeit bond, and commence <br />reclamation on 6/1/89. <br />
